Is it always 50:50?

No. In most cases, the housing and other needs of both spouses – and particularly the children involved – will be the most influential factor.

If there is enough money to meet basic housing and other needs, then courts may well divide assets equally. Assets built up during the marriage are more likely to be divided equally than those that were brought into the marriage originally, or which have been inherited (non-matrimonial assets).
