Protecting assets

Dealing with finances on separation can be a difficult and emotive time.  Sometimes your spouse may react by trying to sell property, shares or other assets or even give them away to prevent you receiving them as part of the financial settlement.  To stop your spouse doing this, there are two ways in which the court can intervene in the disposal of these assets:

  • Section 37 Injunctions; and
  • Freezing Injunction.  

Time is of the essence in this situation. It is important that you instruct a solicitor who is able to act quickly and effectively, especially if you suspect your spouse is potentially going to sell or gift assets away to prevent you from getting your entitled settlement.
