Imerman v. Imerman - restrictions on self-help

Last week the Court of Appeal handed down judgment in the case of Imerman v Imerman.

This decision has far reaching consequences for those considering a so-called ‘self-help’ divorce.  Doubt has now been cast on the rules regarding access to, removal and copying of documents belonging to others (for example an ex-partner/spouse).  Our national team of family lawyers are currently considering the far reaching implications of this decision and a full case update will be posted shortly.  In the interim, if you are considering or involved in divorce proceedings which include the possibility of documentation being removed or copied please contact us for immediate legal advice before taking any such course of action. Otherwise you may be at risk of committing a criminal offence and/or committing a breach of confidence with the possibility of being liable to pay damages.
