In spring this year, the Law Lords clarified the approach that the courts should take to cohabitants’ property disputes in the landmark case of Stack v Dowden.

This summer the Law Commission, the Government’s advisory body on law reform, released its recommendations for how the law should be changed to make rights and responsibilities clearer for everyone. In the seminar notes, Suzy Ashworth, professional support lawyer to the Mills & Reeve family team, looks in detail at what this means for the law as it applies to those couples who live together but do not marry.
