Proposals to clarify European divorce law examined

 

A committee of MEPs has started looking closely at proposals from the EU Commission to clarify European divorce laws in relation to couples from different member states.

The proposals aim to prevent the current dash to file proceedings, as where there are different states involved it is usually the case that the first person to file the divorce papers fixes the court’s powers in that country.

Under the proposals, parties would be able to choose from the outset what law will govern matters relating to the marriage and will require the relevant state to notify them when the law changes.
