The general rule in relation to children is that jurisdiction is based on the child’s habitual residence. This jurisdiction does not normally change even if the child later moves to another country. This general rule is subject to certain exceptions where there has been child abduction, where there may be a closer connection with another EU member state, where it is not possible to determine the child’s habitual residence, where the child has previously lived in another EU member state and where the court which has jurisdiction transfers the case to a country which is better placed to deal with it.
