Separation usually involves some discussion about immediate concerns:
  • What are the arrangements for the children?
  • Will there be a change to the banking arrangements?
  • Can we cope with the extra expense of running two households?
Seeing a solicitor at this point, for a preliminary consultation, can be reassuring. It may not be necessary to change any of the arrangements. To do so might be to invite unwelcome legal proceedings.
Immediate legal action through the courts may well be necessary if:
  • there is domestic violence; or
  • there is an international element to your marriage and divorce proceedings might be issued elsewhere.
If there is domestic violence, you can telephone the police. You should consult a solicitor immediately.

If there is an international element to your marriage, you should also take immediate legal advice if there is a threat of proceedings being issued in another country.
