Importance of consent in fertility treatments

Case: AB v CD 

Our Manchester team represented the third party intervener, the fertility clinic, in a difficult case where the non-birth mother of twins could not be declared a legal parent because of failures in the processes to obtain adequate consent to fertility treatment. The decision underlines the complexities of the law and the careful attention needed by couples embarking on fertility treatment as well as their clinics. The case led to a nationwide audit of fertility clinics which uncovered that in a high proportion of treatments there had been procedural or paperwork errors meaning that the father or second parent’s legal status was potentially questionable.
