Ruling on disclosure of sensitive trust documents

Case: Tchenguiz-Imerman v Imerman

Caitlin Jenkins represented the beneficiaries of substantial Jersey trusts that were being challenged by the wife in highly contested financial proceedings. The beneficiaries were the adult children of the husband from a previous relationship and had been joined into the proceedings. In both the English and Jersey courts there were complex questions of disclosure of documents relating to the way in which the trustees would exercise their powers to distribute funds in the future. Ultimately, the issues were resolved by consent but the judgment provides important clarification for lawyers.
