Could you get a contribution towards the cost of mediation under the Family Mediation Voucher Scheme?

In March 2021, the Ministry of Justice launched a time-limited voucher scheme under which separated partners could be entitled to a £500 contribution towards the cost of mediation. Since then, the scheme has been extended twice, most recently last month.

What is mediation?

In mediation, separated partners agree to meet with an independent third-party family mediator who facilitates discussions around disputed issues, to try and reach agreement. Mediation is generally quicker, more cost-effective and less stressful than going to court.

What is the Family Mediation Voucher Scheme?

Under the scheme, separated partners can obtain a contribution of up to £500 towards mediation in eligible cases. The scheme was set up by the government to encourage more separated partners to consider mediation as an alternative to court.

Am I eligible?

Before going to court or beginning the mediation process, you must attend a Mediation Information Assessment Meeting (‘MIAM’), unless you have a valid exemption. You will have to pay for the MIAM, unless you are eligible for legal aid.

At the MIAM, a trained mediator will consider your eligibility for the Family Mediation Voucher Scheme. The following matters are eligible:

  • A dispute or application regarding a child; and
  • A dispute or application regarding family financial matters where you are also involved in a dispute or application relating to a child.

If your matter is eligible, your mediator will apply for voucher funding. The money will be paid directly to your mediator once the mediation sessions have finished. You will not be entitled to more than one voucher.

Will the voucher cover the cost of mediation in full?

The cost of mediation depends on various factors, such as how much your mediator charges and how many sessions are required.

If the total cost of the sessions is more than £500 and you are not eligible for legal aid, you will have to contribute. Your mediator should discuss costs with you during the MIAM.
